Judges Often Consider The Time In Which A Prenuptial Agreement Was Executed

A poorly crafted prenup signed a few weeks before the wedding is likely to be looked at with suspicion. Prenuptial agreements take time to complete. Six months or more is not unusual.
Under California law, there is a critical timing requirement known as the “7-day rule.” Part of Family Code § 1615(c)(2), this rule states that a person must be given at least seven days to review the final version of a prenuptial agreement before signing it, especially if an attorney does not represent them. However, this rule applies even if both parties voluntarily waive the right to legal counsel. The countdown begins once the final draft, not a preliminary version, is presented.
This waiting period allows both parties enough time to understand the terms fully and seek legal guidance if necessary. If the agreement is signed without honoring this seven-day window, it may be challenged in court and potentially ruled unenforceable.
