SERVING SOUTHERN CALIFORNIA’S HIGH-ASSET DIVORCE NEEDS

Does a prenup make divorce more likely?

You have decided that you would like to use a prenuptial agreement. You think that it will make an eventual divorce easier, and you also want to protect assets that you own.

However, your significant other does not agree. They tell you that they do not want to use a prenup because they think it will make a divorce more likely. They are worried that it would put the marriage itself at risk. Instead of using a prenup, they would rather focus on not getting divorced at all.

But is this correct? Does signing a prenuptial agreement mean that a divorce is more likely?

A prenup can actually help a marriage

In some ways, a prenuptial agreement can actually make a marriage more stable and long-lasting, rather than making it more likely to fail and end in divorce.

A big reason for this is that communication is necessary for a prenuptial agreement. The couple has to sit down and have deep and real conversations about their plans for the future, their financial views and what they expect moving forward.

Many couples never have these conversations. Then they run into conflicts, such as disagreements about how to use shared funds or things of this nature. One common conflict is when one spouse is a saver and the other is a spender, so they just disagree about how they should use money. Because drafting a prenuptial agreement makes couples talk about these things in advance, they can have these important conversations before they even get married, making the marriage stronger.

If you are still interested in drafting a prenuptial agreement this year, you just need to know what steps to take.
